Welcome to the Wild Focus Photography Tours website (the “Site”), operated by Wild Focus Photography Tours LLC (“Wild Focus”, “we,” “us,” or “our”). These Terms and Conditions govern your use of the Site and participation in our guided wildlife photography tours, and related services (collectively, “Tours”). If you do not agree, please do not use the Site or book any Tour.
The information provided on this Site is for general information purposes only and does not constitute a contractual offer. Tour itineraries, pricing, accommodations, and services may change due to weather, wildlife activity, park regulations, safety considerations, and other circumstances beyond our control. Final tour details are governed by your booking confirmation, signed Tour Agreement, Liability Waiver, and these Terms & Conditions.
Terms & Conditions
Wild Focus provides guided wildlife and nature photography tours and related services. While we make every effort to locate and observe wildlife during Tours, we cannot guarantee specific sightings or encounters, as wildlife behavior is unpredictable and influenced by many natural factors.
Tour details, itineraries, inclusions, and exclusions are described on the Site or in your booking confirmation.
A Non-Refundable Initial Deposit equal to fifty (50%) of the total Tour cost is required at the time of booking.
Within two (2) business days, Wild Focus will email your Tour Agreement and Liability Waiver with instructions. Your completed Tour Agreement must be returned within three (3) business days of receipt. A Reservation is not considered confirmed until Wild Focus has received the Non-Refundable Initial Deposit (or full payment, if applicable), the signed Tour Agreement, and the signed Liability Waiver. Wild Focus reserves the right to cancel your Reservation space if the required documents and deposit are not received within the stated timeframe and no prior arrangements have been made.
The remaining Tour balance is due no later than 60 days prior to the Tour Departure Date, unless otherwise agreed to in writing by Wild Focus. Failure to pay the remaining balance by the due date may result in cancellation of your Reservation without refund of the initial deposit. We accept Visa, Mastercard, American Express, Discover, Apple Pay, Pay Pal, and Google Pay payment methods. All prices are subject to change until the initial deposit has been successfully processed.
The initial deposit is non-refundable under all circumstances.
If you cancel more than 60 days prior to the Tour departure date, any payments received beyond the non-refundable initial deposit will be refunded, minus any non-recoverable costs incurred by Wild Focus.
If you cancel 60 days or fewer prior to the Tour departure date, or fail to arrive for your scheduled Tour, the entire Tour cost is forfeited with no refund.
Circumstances that may require Wild Focus to cancel, postpone, or modify a Tour include insufficient enrollment, safety concerns, weather, natural disasters, park closures, force majeure events, or other events beyond Wild Focus’ reasonable control. If Wild Focus must cancel a Tour, we will do everything reasonably we can to preserve the value of your Reservation by offering, where feasible, rescheduling options or a future Tour credit equal to the Non-Refundable Initial Deposit. Any amounts paid beyond the Non-Refundable Initial Deposit will be refunded. Wild Focus is not responsible for additional expenses incurred by Participants, lodging, meals, rental vehicles, or other travel-related expenses.
For your protection, we strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, medical emergencies, evacuation, and other unforeseen travel interruptions.
Cancellation policies become effective once your reservation has been confirmed. A reservation is considered confirmed after your initial deposit has been successfully processed and your completed Tour Agreement and Liability Waiver has been received by Wild Focus.
Guide gratuities are not included in published tour or workshop prices. Gratuities are discretionary and should reflect the participant's experience and level of service received. As a general guideline, a gratuity of approximately 20% of the retail price of the tour or workshop is customary and appreciated. Promotional pricing, discounts, or other reductions in the amount paid do not alter the retail price used as the reference for calculating a suggested gratuity.
Participants must be at least 18 years of age or older or 15 years of age or older and accompanied by a guardian.
You confirm that you are physically and mentally capable of safely participating in the activities included in the Tour, including extended periods of walking or hiking over uneven terrain, entering and exiting vehicles, and spending long days outdoors in variable weather conditions. Wild Focus reserves the right to determine whether a Participant can safely participate in the Tour and decline participation or require reasonable modifications when necessary for the safety of the Participant, other guests, or wildlife.
Participants agree to promptly disclose to Wild Focus any medical conditions, allergies, dietary restrictions, mobility concerns, or cognitive impairments, or other circumstances that may affect their ability to safely participate or require accommodation. Whenever reasonably possible, this information must be provided to Wild Focus no later than thirty (30) days prior to the Departure Date. Wild Focus will make reasonable efforts to accommodate participants when feasible; however requests made after this timeframe may not be able to be accommodated.
You agree to follow all instructions from guides, respect wildlife and protected areas, wildlife protection laws, comply with all applicable laws and Leave No Trace principles. Participants are responsible for ensuring they bring appropriate clothing and personal gear for weather conditions as outlined in the pre-tour packing list.
Failure to comply may result in removal from the Tour without refund.
Participation in Tours involves inherent risks including (but not limited to) injury, illness, property damage, or death due to terrain, weather, wildlife encounters, physical exertion, transportation, or other wilderness hazards. You voluntarily assume all such risks. To the fullest extent permitted by law, you release Wild Focus, its owners, guides, employees, and affiliates from any and all liability for any claims arising from your participation, except those caused by gross negligence or willful misconduct. A separate Liability Waiver will be required prior to the Tour Reservation being completed.
You retain full copyright ownership of photographs that you personally take during the Tour. We retain the right to photograph participants (including you) and to use such images, along with any other content created by our guides or provided by us, for promotional, marketing, educational, and business purposes without additional compensation to you, unless otherwise agreed in writing. You agree not to commercially exploit or sell images featuring other participants without their consent.
Wild Focus retains all rights to its instructional materials, educational content, guiding methods, Tour curriculum, photography instruction, wildlife interpretation, presentations, written materials, and other proprietary content provided during the Tour.
Participants may photograph and record reasonable portions of their personal experience for personal, non-commercial use.
However, participants may not record, reproduce, distribute, publish, sell, or otherwise commercially exploit substantial portions of Wild Focus’ instructional presentations, guiding, photography instruction, wildlife interpretation, educational discussions, or other proprietary content. Additionally, recording or transmitting instructional content for the purpose of creating educational materials, competing tours, online courses, or commercial content is prohibited. Wild Focus educational content may not be reproduced, recorded for redistribution, uploaded to AI training systems, or incorporated into commercial education products without written permission from Wild Focus Photography Tours LLC.
All content on this website–including but not limited to, text, photography, graphics, videos, logos, design elements, branding, tour descriptions, educational materials, downloadable documents and other original content, is the property of Wild Focus Photography Tours LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.
No portion of this website may be copied, reproduced, modified, distributed, published, used for commercial purposes, or used to create derivative works without prior written permission from Wild Focus Photography Tours LLC.
Content from this website may not be used to train artificial intelligence systems, large language models, machine learning models, or similar technologies, nor may it be incorporated into automated datasets or commercial AI products.
In no event shall we be liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the amount paid for the Tour.
These Terms are governed by the laws of the State of Utah. Any disputes shall be resolved exclusively in the courts of Utah County, Utah.
Wild Focus may update these Terms and Conditions periodically. Continued use of the Site or participation in Tours constitutes acceptance of the revised Terms and Conditions.
